The VISUAMED platform is an application developed by TECHER TEAM, S.L. (which currently manages it) based on virtual reality technology, the purpose of which is to create a virtual and interactive environment that allows users to perform immersive surgical planning and intervention tasks. This Privacy Policy indicates what personal information VISUAMED -or its owner TECHER TEAM- collects, uses, shares and processes from users ("Users" or "User") who interact with VISUAMED through the websites, applications, services or, where applicable, connected devices (such as virtual reality goggles).

2. INFORMATION AND CONSENT

In accordance with current European and national Data Protection regulations, by accepting this Privacy Policy the User gives his/her informed, express, free and unequivocal consent for VISUAMED or its owner TECHER TEAM to process the personal data collected through the website visuamed.com and its Platform and the Virtual Reality experience either through the forms provided, or through the information collected by cookies, or by any other related means.

Likewise, the User consents to this data being processed by VISUAMED or its owner TECHER TEAM by applying the required organisational and security measures.

The User guarantees that the personal data provided to VISUAMED or its owner TECHER TEAM is true and accurate, and VISUAMED or its owner TECHER TEAM will not be held responsible for any incident arising from the inaccuracy or falsity of the information provided by Users, beyond the possibility of the User exercising their right to rectification.

3. PURPOSE OF DATA PROCESSING

In addition to managing requests for information, content or services expressly requested by Users or with their consent, VISUAMED or its owner TECHER TEAM has a legitimate interest in using the information collected to:

  • improving the website, its management and security;
  • optimisation of the VR user experience;
  • to carry out studies to analyse the relevance and use of VISUAMED (online and VR), by means of anonymised information;
  • when permitted by applicable regulations, to inform Users about the services offered by VISUAMED or its owner TECHER TEAM through publications, seminars and other initiatives;
  • in the purchase and delivery of products and services, to accept and manage orders, deliver services, process payments and communicate with you regarding VISUAMED;
  • perform analysis of the User interactions with the Platform (online and VR Experience).
  • provide customer support services, including resolving your queries and complaints (including problem resolution), whether you contact us by telephone, text message, email, chat, forms, letter, the Website or through social media owned by VISUAMED or its owner TECHER TEAM;
  • detecting, preventing and investigating criminal and other unlawful activities; protecting user safety and exercising our civil rights in court. For example, where necessary, we may share your Information with law enforcement agencies or use it to bring legal action against you to enforce our rights;
  • comply with obligations imposed by law. For example, to comply with accounting regulations, to respond to requests for individual rights and to comply with requests from regulators, judicial authorities and governmental and law enforcement agencies.

Please note that while Information may be processed for more than one purpose, for example, the information we obtain in providing our offer may also be used to improve and develop our services. Not all of the purposes or processing activities set out below apply in all cases. Our particular use of your information will depend on the offering you sign up for and how you interact with us, including the permissions you grant us and other controls you exercise in connection with our processing of your information.

VISUAMED or its owner TECHER TEAM is entitled to process the data of the Users on the basis of the express consent of the data subject, requested for the specific case.

4. DATA COLLECTED

When entering and visiting the website, no data is automatically recorded that would allow the user to be identified by name. However, certain information is collected and recorded in the systems of VISUAMED or its owner TECHER TEAM and therefore of VISUAMED or its owner TECHER TEAM in order to improve the User's browsing experience (online and VR) and the management of the website itself.

Notwithstanding the above, in order to access certain information or to use certain services on the Website and VR application, such as the use of the Platform, VISUAMED or its owner TECHER TEAM may require certain personal data from the User: name, surname, medical speciality, registration number, hospital in which he/she works, position held, personnel in his/her charge, e-mail address, curriculum, country, addresses, telephone number, company, position and professional contact details.

In addition to the aforementioned data, it is also possible to add other information related to personal content provided by the User, information related to networks and connections accessed by the User, data derived from the use of the services of VISUAMED or its owner TECHER TEAM and data derived from transactions carried out in reference to the products or uses of VISUAMED or its owner TECHER TEAM. The aforementioned data should be understood to be by way of example, and in no way limited.

The obligatory or optional nature of the data requested from the User will be indicated on the corresponding form by means of an asterisk. Failure to provide certain information marked as compulsory may make it impossible for us to provide our services.

With regard to the personal information provided, as indicated in this section, VISUAMED or its owner TECHER TEAM undertakes not to alter the content of any of the data provided.

5. DATA RETENTION PERIOD

VISUAMED or its owner TECHER TEAM will only keep users' personal data for the time necessary to carry out the purposes for which they were collected, until such time as the consent given has been revoked. We retain your personal information so that you can use the services of VISUAMED or its owner TECHER TEAM on an ongoing basis and for as long as necessary to fulfil the purposes described in this Privacy Policy, as required by law, or as otherwise communicated to you by us.

  • Purposes related to the performance of a contract: as regards the use of your information for the management of contractual obligations we have with the User, we will retain such data for the duration of the contract and for ten years thereafter in order to be able to respond to any subsequent queries or complaints.
  • Purposes related to the fulfilment of legal and regulatory obligations: certain information must be kept for the periods required by the specific applicable regulations (tax, commercial, money laundering, etc.).
  • Purposes related to the management of enquiries made through the enquiry form: your data will remain active until the resolution of your request for information.
  • Purposes related to the management of the personnel selection process: the data you provide us with in relation to the job offers you wish to subscribe to will be kept for one year, from the date of the last update.

Once the retention period has expired, the Information is securely deleted, unless it is necessary to retain it in order to bring, exercise or defend legal proceedings. 6. SECURITY MEASURES

VISUAMED or its owner TECHER TEAM is committed to the protection of the personal data and privacy of the Users, and in order to protect the different types of data reflected in this privacy policy, the security levels required by Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR) on the protection of individuals with regard to the processing of personal data will be adopted, adapted to the nature of the data being processed at all times.

7. DATA COMMUNICATIONS

VISUAMED or its owner TECHER TEAM informs the User that their data may be communicated to third parties -data processors- in order to be able to deal with their requests, manage the services they contract and inform them about services, events and news related to our professional activity. Your data may also be used for the purpose of generating information from which to derive trends and information on the effectiveness of the services provided by VISUAMED or its owner TECHER TEAM, all with the aim of improving the services provided to VISUAMED Users or its owner TECHER TEAM.

The third parties/companies/entities to whom the personal data collected is transferred will act as data processors, and will only be given this personal data when it is necessary to provide the services contracted with VISUAMED or its owner TECHER TEAM or to carry out any action previously accepted by the User.

In addition, we inform you that certain data, within the framework of the regulations in force, may be communicated to the competent authorities in the exercise of their functions.

VISUAMED or its owner TECHER TEAM does not have service providers for the maintenance of the platform outside the European Union, so there are no international data transfers.

Some of our services contain links to other sites, including social media sites, for customer interaction and marketing purposes. Visitors should consult the privacy policies and terms of those other sites before submitting their personal information, as we do not exercise control over the personal information that is submitted to or obtained by those third parties.

We may from time to time offer services that are sponsored by or co-branded with certain third parties. We do not exercise any control over such third parties' use of personal information. We encourage you to read their privacy policies to learn about their data practices before providing information through sponsored or co-branded content or programs.

8. USER RIGHTS

The User may exercise, at any time and free of charge, the following rights where applicable if TECHER TEAM as owner of the VISUAMED brand is responsible:

  • Right of access, knowledge, updating and rectification : The user may request details of the Information we hold, together with a copy of their Information, and the correction of any errors it may contain.
  • Right to erasure or deletion ("right to be forgotten"): The right, in certain circumstances, to request that your Information be deleted. In specific cases, we may not be able to delete certain types of Information; in particular, where we are required by law to retain it.
  • Right to portability : The right in some cases to receive your Information in a digital format or to have it sent directly to another Data Controller (where technically feasible).
  • Right to object: The right to object (on grounds relating to your particular situation) to the processing of your Information based on our legitimate interests or the consent you have given us.
  • Right to revoke consent : You may revoke your consent at any time with respect to any processing of Information that is based on consent.

The user can contact TECHER TEAM as the owner of the VISUAMED trademark by writing to TECHER TEAM at Avda. Marqués de Sotelo, 9-9 (46002 - Valencia, Spain) or by sending an e-mail to info@visuamed.com  (indicating name, surname, e-mail address, ID card or passport number). You may also contact the Spanish Data Protection Agency.

Your exercise of these rights is subject to certain exceptions for reasons of general interest (e.g., the prevention or detection of crime) and for our own interests (e.g.,. maintaining the confidentiality of legal advice). If you exercise any of these rights, we will check that you are actually entitled to do so.

The fact that you may withdraw your consent to the processing of your personal data at any time shall not affect the processing of data that VISUAMED or its owner TECHER TEAM may have carried out at any time prior to such withdrawal.

9. MODIFICATION OF THIS PRIVACY POLICY.

In the event that the terms of this Privacy Policy are modified, we will inform the User of the new policy and, if necessary, request the User's consent.

10. ACCEPTANCE OF THE PRIVACY POLICY

The User acknowledges having read and understood this Privacy Policy and expressly agrees to be bound by the terms set forth herein, to the full extent and scope thereof, without exception to any of its provisions.
